General Terms and Conditions (AGB)
Scope
The following terms and conditions apply to contracts that you conclude with us as the provider Papes UG via the website https://www.papes.art/. Unless otherwise agreed, the inclusion of any of your own conditions that you may use is contradicted.
A consumer in the sense of the following provisions is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their independent professional activity. An entrepreneur is any natural or legal person or a legally capable partnership that acts in the exercise of its independent professional or commercial activity when concluding a legal transaction.

Contract Subject
Papes UG offers artistically designed rolling paper booklets, created in collaboration with artists (hereinafter referred to as 'PAPES'). A portion of the profit is shared with the artists. The products are exclusive and available approximately monthly.
Conclusion of Contract
The presentation of goods in our online store does not represent a legally binding contractual offer on our part, but is only a non-binding invitation to consumers to order goods. By ordering the desired goods, the consumer submits a binding offer for the conclusion of a purchase contract.
Upon receipt of an order in our online store, the following rules apply: The consumer submits a binding contractual offer by successfully completing the ordering procedure in our online store.
The order is made in the following steps:
- Selection of the desired quantity
- Selection of desired purchase frequency (one-time, monthly subscription, bimonthly subscription, quarterly subscription)
- Confirmation by clicking the "Order" button in the shopping cart
- Payment process using the provided methods (Visa, Mastercard, American Express, Apple Pay, Google Pay, Klarna, Maestro, ShopPay, UnionPay, PayPal)
- Reviewing or correcting the entered data
- Binding submission of the order
Before the binding submission of the order, the consumer can return to the page where the customer's details are recorded and correct input errors or cancel the order process by closing the Internet browser. We immediately confirm receipt of the order via an automatically generated email ("Order Confirmation"). With this, we accept your offer.
Prices and Payment
The prices listed on the product pages include statutory VAT and other price components. In addition to the stated prices, we charge for delivery. The shipping costs are dependent on the country of destination and are clearly communicated to you on the order page.
Delivery and Shipping
Delivery: Delivery is available worldwide via standard mail services. The typical delivery time within Germany is 3 to 10 business days. The customer is responsible for all applicable shipping costs.
Delivery Delays: While we make every effort to adhere to the estimated delivery dates, unforeseen circumstances may cause delays. In the event of any significant changes to the delivery schedule, we will notify you promptly. Should there be a substantial delay, you will have the right to cancel your order and receive a full refund.
Pre- and One-Time Orders
Product Availability: Certain products offered on our website may be available for pre-order. Pre-ordered products are not immediately available for shipment and will be dispatched on or around the estimated delivery date provided at the time of placing the pre-order. This estimated date is indicative and may be subject to adjustments.
Payment: Payment for pre-ordered items may be required at the time of placing the order. A pre-order is considered confirmed upon receipt of full payment, in accordance with our payment terms. A one-time order is deemed complete only when the full payment amount has been received.
Cancellation and Refunds: You have the right to cancel and receive a refund for pre-orders and one-time orders within 14 days of receiving the product, in line with your statutory right of withdrawal. If the product has already been shipped, you are required to return the product. Please refer to our refund policy for detailed instructions on the return process.

Subscription and Cancellations
Subscriptions: We offer subscription services that include monthly, bimonthly, and quarterly options, each providing regular deliveries of PAPES. All subscriptions will automatically renew at the end of each subscription period. By subscribing, you acknowledge and agree that your subscription will continue to renew automatically, and your chosen payment method will be charged accordingly, unless you cancel your subscription or we suspend or terminate it in accordance with these Terms and Conditions.
You will be charged six (6) weeks before each scheduled PAPES drop. A “drop” refers to the availability of PAPES for purchase and delivery, following the completion of a six-week printing process. If you place an order within six weeks of a scheduled drop, you may also be charged at the time of the order, provided that stock is available. We will notify you clearly of any such charges at the time of purchase.
Cancellation: You have the right to cancel your subscription within 14 days of receiving your first order, in accordance with applicable consumer protection laws. Beyond this period, cancellations must be made at least one (1) month prior to the next scheduled product drop, due to the time required for the printing process. Cancellations made after this deadline will take effect following the subsequent product drop.
Right of Retention / Retention of Title
You can only exercise a right of retention insofar as it concerns claims from the same contractual relationship. The goods remain our property until full payment of the purchase price is made.
Warranty
Statutory defect liability rights exist. As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects, and transport damage, and to notify us and the carrier of any complaints as soon as possible. Failure to do so does not affect your statutory warranty claims.
If a characteristic of the goods deviates from the objective requirements, the deviation is only deemed agreed if you were informed of this before submitting the contract declaration and the deviation was expressly and separately agreed between the contractual parties.

Choice of Law / Place of Fulfillment / Jurisdiction
German law applies. For consumers, this choice of law only applies insofar as the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn (favorability principle).
The place of fulfillment for all services from the business relationships with us and the place of jurisdiction is our registered office, provided you are not a consumer but a merchant, a legal entity under public law, or a special fund under public law. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if your place of residence or habitual abode is unknown at the time of the commencement of proceedings. The right to also appeal to the court at another statutory place of jurisdiction remains unaffected.

The European Commission provides a platform for the extrajudicial online dispute resolution (OS platform), accessible at https://ec.europa.eu/odr.
We are neither willing nor obliged to participate in dispute resolution procedures before consumer arbitration boards.
